These Terms of Service (“Terms”) govern your access to and use of the software, websites, APIs, and services (the “Services”) provided by LuxePlatforms LLC (“LuxePlatforms,” “we,” “us”). By creating an account or using the Services, you agree to these Terms.
The Services
LuxePlatforms provides cloud-based software on a subscription basis, including the Website Grader API and the AI Receptionist. We may update, improve, or change features over time. We aim for high availability but do not guarantee the Services will be uninterrupted or error-free.
Accounts
You are responsible for the accuracy of the information you provide, for keeping your credentials and API keys secure, and for all activity under your account. Notify us promptly of any unauthorized use.
Subscriptions, billing, and merchant of record
Paid plans are billed as recurring monthly subscriptions in U.S. dollars and renew automatically until cancelled. Our order process and payments are conducted by our online reseller, Paddle.com, which is the Merchant of Record for our orders. Paddle handles customer service inquiries and returns related to payments, and applicable taxes are calculated and shown at checkout. You may cancel at any time; cancellation stops future renewals.
Acceptable use
You agree not to misuse the Services, including by attempting to breach security, exceed or circumvent rate limits, resell access except as expressly permitted, use the Services to violate any law, or send unlawful, harassing, or fraudulent communications. We may suspend accounts that threaten the security or integrity of the Services.
Intellectual property
The Services, including all software and content we provide, are owned by LuxePlatforms LLC and its licensors. You retain ownership of the data and content you submit, and grant us the limited rights needed to operate and provide the Services to you.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, LuxePlatforms will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim will not exceed the amount you paid for the Services in the twelve months before the event giving rise to the claim.
Termination
You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or to protect the Services. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict-of-laws principles.
Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated date, and continued use of the Services constitutes acceptance of the revised Terms.
